Legal scholars have long been critical of the common law rul that the wrongful death of a human being could not be complained of as an injury.http://www.mcelvainlaw.com/wrongfuldeathact.pdf. Most acts are viewed as providing a remedy, contrary to the common law; Illinois courts have viewed the Illinois Wrongful Death Act as creating the exclusive right of recovery. Historically, the case of Baker v. Bolton has been credited with the origination of the common law rule that the death of a human being could not be complained of as an injury. Such a subtlety was of little concern and merely academic to English legal scholars at that time, since conviction from a felonious death of another was punishable by death and forfeiture of the felon’s entire estate to the Crown. In an endeavor to maintain the distinction between the classes, the Roman law held that no value could be placed on the life of a freeman upon his death. Since the punishment for the felony was the death of a felon and the forfeiture of his property to the Crown, nothing remained for a recovery. This did not speak tot he situations which encompassed a tort resulting in death but were not felonies. However, the evaluation of dependency on the deceased and the monetary loss resulting from his wrongful death are no more difficult to assess that the damages in injuries which do not result in death. The State of Illinois passed its Injuries Act in 1853, allowing for the recovery by the next of kin of the injured party for the pecuniary loss suffered by his death if the injured party would have been entitled to maintain an action had death not ensued. The Wrongful Death Act falls far short of providing ...

Saint Mark’s congregation will provide a ministry of presence in the face of death.http://www.stmarkalaska.org/deathdyinggde.pdf. For the Christian, getting ready for death is not simply allowing death to come passively while submitting to medical and religious experiences. Friends and family should deliberately take a positive role in their loved one’s death, for it is the last inheritance and memory of who the person is and was, a memory that will be held forever by the survivors. To place things in a proper perspective we give you “A child’s understanding of death and dying” as a role model for the adult. Kids talk about death. A child’s conversation on death is short and frequent; they then go back into what they do best, enjoying life. However, stay away from most forms of non-traditional medicine; faith healers and others are just out to take your money, preying on the fear of death. As death comes near please contact the pastor to come to the bedside to offer prayer and read from scripture. Then, as death approaches, a last blessing may be given to the dying and family GIVING IN DEATH 2. Survivors often have “thin skin” after a death, so be nice to one another. After someone dies, you eat death for a while. Meals are awkward and empty- death is there. Can’t quit thinking about death’s details. You are a survivor of a loved one’s death.

In this paper I will explain my understanding of the Biblical perspective of death.http://www.ntgreek.org/SeminaryPapers/systematic/Death.pdf. The paper will be limited to the concept of death only as it relates to human beings, not to plants or animals, or other types of living things. I will not only define what death is, but will also differentiate between physical and spiritual death, explain why humans die, tell what happens after a person dies, and then explain what a Christian’s attitude toward death should be. Physical death can be defined from both a medical and theological perspective. Medically speaking, death is the total and permanent cessation of all vital bodily functions. Ecclesiastes says concerning death: “then the dust will return to the earth as it was, and the spirit will return to God who gave it” (Eccles 12:7).1 After death, the physical body decays and thus is resolved into its constituent elements. Physical and Spiritual Death When the Bible talks about death related to human beings, it makes a distinction between physical death and spiritual death. Spiritual death is a state of being in which the human soul is separated from God and has not been enlivened by his Spirit. As a normal course of experience, every human being will experience physical death. If a person has not been spiritually enlivened, after their physical death they will be separated from God eternally. What is the cause of death? Romans 5:12 associates this penalty for initial sin with all humans by stating that “sin came into the world through one man, and death came through sin, and so death spread to all because all have sinned” and Romans 6:23 further makes this clear in declaring ...

DOJ has implemented an extensive revision to its death penalty protocol, USAM 9- 10.http://www.capdefnet.org/pdf_library/Summary_of_changes_in_2007_DOJ_death_penalty_protocol.pdf.000 et seq.. The revisions are effective July 1, 2007 and may be found at http://www.usdoj.gov/usao/eousa/foia_reading_room/usam/title9/10mcrm.htm#9-10.010 Overall, the revised protocol reflects the Ashcroft/Gonzales DOJ’s objective of greater nationwide uniformity in death penalty charging practices through greater centralized control at The changes also impose strict new confidentiality requirements at all levels, and thus appear designed to make federal death penalty charging practices less transparent and accessible to the public. The major changes contained in this revision are: The revised regs impose strict confidentiality requirements on all government attorneys, forbidding any prosecutor or DOJ official from disclosing whether he or she favors seeking the death penalty, accepting a plea agreement, etc., except by the personal The regs make explicit DOJ’s determination to apply a single national standard to death penalty decision-making in order to achieve “consistent and even-handed national application of Federal capital sentencing law.” DOJ has removed a possible loophole in its centralized death penalty authority by making clear that all cases must be submitted to the Department for a final death penalty decision by the Attorney General when a death-eligible offense is or “could be” charged in the indictment. Yet the stench of death still hangs heavy in the air.http://www.edenucc.com/from_client/03-25_gh_loved_to_death.pdf. Even when face-to-face with resurrection, we cannot escape death. These stories force us to confront death, not just any death but the death of Jesus, the death of the very object of hope and faith. I dare say that many of us do not do this very well, we don’t deal well with death. I once heard a striking illustration of the way our American response to death has evolved over the years. Even death itself would one day be overcome. That body in the parlor became an inconvenient reminder that death still had the last word. We moved the unpleasant reminder of death out of the home. If death could not yet be vanquished it could at least be dealt with in an efficient, progressive way, out of sight, by “professionals.” The most dramatic of these recent encounters with death was on September 11, 2001, the horrific death of 2,752 people in the World Trade Centers. Wrap all of this together, September 11th, tens of thousands of war dead, the death of a most loved family member and the death of our planet – this is what the death of Jesus represents. For us this morning , this means that we don’t have to live in the shadow of death, we don’t need to be paralyzed by the presence of death in our lives, we don’t need to assent to the power of death in our world. I have been worrying more than a little lately about death, death in the world around us, death of family and friends, my own death. I thought back to when I felt least anxious, when I was most able to set aside, quiet and transcend dread and despair in the face of death, when the stench of death all but ...

It is not meant to be a comprehensive guide regarding certification of death, nor should it be construed as authoritative legal advice.http://www.osma.org/files/members/Death-new.pdf. Certification of death Physicians should be aware of the legal requirements concerning pro-nouncement of death and the signing of death certificates. Only Physicians Can Pronounce Death One may pronounce a person dead without personally examining the body of the deceased only "if a competent observer has recited the facts of the deceased's present medical condition to the physician and the physician is satisfied that death has occurred." (OAC §4731-14-01) Competent observers are individuals who, by virtue of their training and licensure, are able to assist the physician in making the determination of death. Competent observers are not permit-ted to make a pronouncement of death. Ohio Revised Code (ORC) §3705.16 states “the medical certificate of death shall be completed and signed by the physician who attended the deceased or by the coroner within 48 hours after death." Thus, the attorney general would distin-guish "the physician who attended the deceased" from "any other physi-cian without professional contact with the deceased at or just prior to death." (OAG 76-026) Therefore, the death certificate should be com-pleted and signed by the physician who had professional contact with the OAC §3701-5-07 addresses the situation when a coroner’s investigation or a medical examination do not result in a determination of the cause of death within five days from the date of death. The coroner or attending phy-sician, as applicable, shall sign the certificate of death, enter ‘cause of death ...

In the United States, the principle that death can be diagnosed by neurologic criteria (designated as brain death) is the basis of the Uniform Determination of Death Act,1 although the law does not define any of the specifics of the clinical diagnosis.http://www.ctdn.org/downloads/TheDiagnosisofBrainDeath.pdf. There is a clear difference between severe brain damage and brain death. The physician must un-derstand this difference, because brain death means that life support is useless, and brain death is the prin-cipal requisite for the donation of organs for trans-plantation. The Conference of Medical Royal Colleges and their Faculties in the United Kingdom8 published a statement on the diagnosis of brain death in 1976 in which brain death was defined as complete, irreversible loss of brain-stem function. Research published its guidelines.9 This document recommended the use of confirmatory tests to reduce the duration of the requisite period of observation but recommended a period of 24 hours for patients with anoxic damage, and it made the ruling out of shock a requirement for a determination of brain death. The clinical neurologic examination remains the standard for the determination of brain death and has been adopted by most countries. Interpretation of the computed tomographic (CT) scan is essential for determining the cause of brain death. As brain death occurs, patients lose their reflexes in a rostral-to-caudal direction, and the me-dulla oblongata is the last part of the brain to cease to function. Because of the limita-tions on the clinical examination of neonates, an ob-servation period of 48 hours is recommended, as well as a confirmatory test, such as ...

To help children cope with a death, we must understand how they think about death and what has changed for them.http://www.ccgacares.com/mhmatters/kids/death-of-loved-one.pdf. No two children respond exactly the same way to the death of a love one. Children are likely to respond to death differently and need different kinds of help, depending on their prior experience, their age, and what happens after the death. This does not mean your child believes in ghosts, simply that he or she does not understand that death is really the end. Explain your family's spiritual beliefs about death in very simple terms. But be prepared for the likelihood, that your young child may repeat what you say and then behave like he does not understand what death means. You may be concerned about how a death will affect your young child in the long run. After a death it is important that your child is allowed to share in the family grief process, but just as with adults he will cope best if returned to a normal routine as soon as possible. Because young children do not understand that death is final, your preschooler may go on happily playing and going about regular activities, even after the death of someone very important to her. The child will feel sad, as he becomes more aware of what death means in his life. School-Age Children With the death of an important loved one or parent, expect that your school-age child (ages 7-10) will have thoughts that you will die too. School-age children often worry about their own health, especially after the death of a loved one to an illness or one who is also young. Teenage Years Teenagers think much like adults do about death. They know death is the end and ...

Many studies have consistently demonstrated that the race of the victims, the defendants, or both, plays a significant factor in whether death notices are filed and death sentences are imposed.http://www.abolishdeathpenalty.org/PDF/WCADP_Race_Fact_Sheet.pdf. A disturbing fact unveiled in the Illinois report, “Governor’s Commission on Capital Punishment” (April 15, 2002), was that Illinois’ death row population consisted of 66% African-Americans, 20% of whom were convicted or condemned to die by all-white juries. Other studies have further shown that death is disproportionately imposed on African-American defendants and that this trend is heightened when an African-American is charged and convicted of killing a white victim. These same issues are prevalent in Washington State. Race of Defendants Death has been sought in 40% of white defendant cases and in 31% of black defendant cases. Death has been imposed in 14% of the white defendant cases and 17% of the black defendant cases. Death has been sought in 38% of white victim cases and in 11% of black victim cases. Death has been imposed in 14% of the white victim cases and 6% of the black victim cases. Death notices have NEVER been filed in a case with a white defendant and black victim. Death notices have been filed in 42% of the cases with a black defendant and a white victim. Death sentences have NEVER been imposed in a case with a white defendant and black victim. Death sentences have been imposed in 21% of the cases where there is a black defendant and a white victim. Current death row There are ten (10) individuals currently facing a sentence of death.

The Wisconsin Coalition Against the Death Penalty (WCADP) this week expressed disappointment at the introduction of SB115, Sen.http://www.nodeathpenaltywi.org/news/WCADPreleaseinresponsemarch292007.pdf. Alan Lasee’s bill to reinstate the death penalty in Wisconsin. “The death penalty is expensive, ineffective as a crime deterrent, raises serious moral questions, and has resulted in the executions of innocent people,” said Sachin Chheda, Executive Director of WCADP. “Wisconsin has gone over 150 years without executing a prisoner, and there is no logical reason why we should start now.” Across the country, over 120 people have been exonerated and freed from death row since 1973 due to evidence that has confirmed their innocence. In addition, various reports have identified specific individuals who have been executed, but are now widely believed to have been innocent. “No Wisconsin citizen wants an innocent person executed in their name,” said Chheda. “This bill offers no real guarantee that the innocent will be protected.” In addition, costs associated with the death penalty are much higher than those associated with life imprisonment. “States like New York and New Jersey have spent tens of millions of taxpayer dollars to implement death penalty systems that have not made their states safer, and that have not resulted in any actual executions,” said Chheda. “Senator Alan Lasee’s single-minded obsession would result in a massive tax increase for all Wisconsin citizens. We could instead use our hard-earned tax dollars in ways that will actually reduce crime and make communities safer, by supporting improved police, victim and prosecutorial services. “The death penalty is wrong for Wisconsin, and the ...

The great theme of Holy Week is death and resurrection – the movement through death into new life.http://www.zcbclaresangha.org/pubs/GreatDeath.pdf. For many, a more familiar perspective is that life ends in death, all forms of life wear out, and that’s it, the end of the road. Death as the end of the road finds its expression in popular culture. In Zen there’s an expression – the “great death” – that points to a parallel with the Christian belief in death and resurrection. Zen masters speak of the great death and, from compassion born of this death, they wield the sword that cuts off delusion and gives new life. But our initial, conditioned response to this expression might be “what could be so great about death?” Every day in sesshin, we hear the traditional encouragement to Zen students: Life and death are of supreme importance; time passes swiftly by, and opportunity is lost; we must strive to awaken; do not waste your time by night or day. This encouragement urges us on into the great matter, to settle it once and for all, the matter of our life and death. On this Good Friday, let’s look into the great matter and the great death we hear tell of. Dickinson’s poetry is direct and simple with respect to the themes of life and death. A death-blow is a life-blow to some Who, till they died, did not alive become. By all accounts, it was a great death. By all accounts, it was a great death. Tokusan Sengan, Saul of Tarsus, and Emily Dickinson – our heroes in great death – they could not see to see, the sight went clean out of their eyes! Great death and transformation is an apt description of what Tokusan and St. Paul experienced, perhaps less so with Emily Dickinson, ...
