Attempting to stretch existing laws to address previously unforeseen technological issues. Due to a growing consensus that tech-nology alone cannot solve the unsolicited email prob-lem, various legal approaches to regulating unsolicited email have been proposed or adopted. The most successful legal strategy thus far has been lit-igation challenging mass mailings of unsolicited email as a "trespass" to the recipi-ent's servers.   It's amazing to think that my nine-year-old daughter will grow up thinking that eBay always existed when in fact eBay is rela-tively new. A widely circulated story that is still believed by many eBay users says that the auction site that eventually became eBay was conceived initially as a result of a conversation between Omidyar and his wife, Pam. But eBay also provides workshops and tutorials that can come in handy when you encounter a specific problem and need advice, or if you want to meet experienced eBay buyers and sellers in person. You have chances to meet other eBay users face-to-face if you want to at the classes held around the country and the annual eBay Live user convention. You get advice from eBay's own personnel and experienced buyers and sellers, and also questions from visitors that alert you to what's on the mind of the eBay general population. By scanning the posts in the eBay Toolbar workshop, you discover that the eBay Toolbar raises concerns about how

The art of Kelly Heaton exists in that place where obsession, engineering and popular culture come together. -- George Fifield for the catalogue of the 2001 DeCordova Annual Exhibition Live Pelt, by Kelly Heaton, is a multimedia installation based on the transformation of 64 previously owned Tickle Me Elmo dolls, the popular consumer toy, into a woman's coat. Fashioned from the toys' pelts and electronics, the coat (entitled The Surrogate) provides full body vibration and is designed to be a substitute lover. Using Elmo as a vector to channel information about contemporary American culture, the installation encompasses moods both poignant and Frankenstein weird. The Trapper collects Elmos through eBay; The Industrialist performs the skinning; and The Taxidermist stuffs and mounts their heads. The Elmos were purchased through eBay. With circular symmetry, many of the transformed Elmo artworks will be "recycled" for sale on eBay, extending the domain of online commerce

This paper shows empirically that eBay's feedback system doc-uments successful transactions, but often fails to inform users of unsuccessful ones. A data set containing information from 3776 auctions I collected from eBay's platform, gives reason to assume that the feedback system exhibits a positive bias due to the na-ture of mutual feedback that is made public instantly. Electronic markets such as eBay o ffer the advantage of rapidly conveying reputation to other market participants by publicizing feedback. Ebay de fines a successful transaction as an auction that receives at least the minimum bid, or as one in which the secret reserve price has been reached. Ebay assumes that the minimum feedback score deters sellers from engaging in such scams because the collection of such an amount of feedback is costly. Users on eBay have little incentive to leave feedback once a transaction has been completed and hence often they do not bother to do so. Cabral and Hortaçsu (2004)
In auction markets, such as eBay, where the vast majority of sellers are otherwise unknown, the researcher can get precise measures of current reputation. We conducted the first randomized controlled study of the value of eBay reputations in the natural setting of actual eBay auctions. The eBay reputation system enables users to leave feedback about interactions with each other. Users may change their eBay identities by registering again, but must then start all over as new users with a zero reputation score. EBay merely adds together feedback secured as a buyer and as a seller. BP secured many of the benefits of a controlled trial by presenting subjects with actual eBay listings spliced together with fake feedback profiles. We worked with an established eBay dealer with a high reputation (net score above 2000 as of the beginning of the study, with just one negative). In addition to selling items using his established identity with a

With nary a question from investors about a management-enriching stock plan, eBay (Nasdaq) concluded its annual shareholder meeting on Thursday in less than 40 minutes. Last week's vote at eBay suggests that typical investors -- no matter how much they complained after the fact about abuses at Enron, WorldCom, Tyco and others -- still vote with their pocketbooks. If a company's stock is rising, as eBay's surely is, shareholders aren't likely to rock the boat. With the full approval of its board, eBay is issuing ever-increasing amounts of stock options, transferring an unusually large portion of the company's market value to corporate insiders. But last week, eBay shareholders overwhelmingly approved a proposal that would increase the number of shares available under the company's stock plan by more than 50%. Now eBay is cleared to give away an estimated $1 billion worth of options, about $250,000 per employee, this year alone. This year's potential handout is more than

When you connect to eBay, your PC or Mac magically turns into a money machine. The eBay home page, shown in Figure 1-1, is your first step to finding all the cool stuff you can see and do at eBay. You can read more about the eBay home page in Chapter 3 and find out more about My eBay in Chapter 4. Don't rub your eyes -- even squinting hard won't help; eBay has a different version of the home page for those who have never registered on eBay. In eBay Live Auctions, you can bid via eBay's Internet hook-up just as if you were sitting in a chair at the auction house. If you seek this kind of instant gratification on eBay, visit the eBay stores. Visiting eBay Stores is as easy as clicking the eBay Stores link from the home page. Sellers who open an eBay store have to meet a certain level of experience on eBay, and when you buy from eBay Stores, you're protected by the same fraud protection policy that you are covered with in eBay auctions. At some point in your eBay career,

One of the earliest and best known Internet reputation systems is run by eBay, which gathers comments from buyers and sellers about each other after each transaction. We also thank eBay for providing data, and especially Patrick Firouzian and his team for doing the data extraction in the midst of many other responsibilities. Before turning to our actual data, it is worth looking at how the eBay reputation system actually works. Before participating in any auctions, as either buyer or seller, people (henceforth called users, as in users of the auction service) register, providing information to eBay, including name and contact information. EBay does not reveal the real names and physical addresses provided during registration to other users. It is possible to scroll through any or all of the comments, but eBay does not provide an easy way to search for the negative and neutral comments. User names are disguised in this and other figures to protect the privacy of eBay users.

eBay came out with excellent results that blew past the markets consensus estimates and its own forecasts. Chief financial officer Rajiv Dutta himself acknowledged in the conference call that said 2003 will go down as an "inflection year" as eBay matures and that the company is likely to face growing litigation expenses. EBay spent $96 million on "general and administrative" expenses in the fourth quarter of 2003, up 52% from the $63.3 million it spent in the same period of 2002.   senior level decisionmakers to manage their businesses in a manner that drives sharehold-er value and profits. Since increasing sales is diffi-cult in today's economy, the inevitable focus is on how to reduce costs and responsibly cut what is usually called discretionary spending. But what counts as discretionary spending varies by company, and its definition for any particular enterprise speaks volumes about the CEO's pri-orities, the compa-ny's commitment to building long-term profitable customer relationships and its understanding of the organizational capabilities that truly drive customer value. Consider how three corporate leaders Palo Alto, Calif.-based Hewlett-Packard Co., Seattle-based Starbucks Corp. and San Jose, Calif.-based eBay Inc.-have fared in understanding the importance of their respective brands even in a down economy. Auction site eBay, on the other hand, wants to extend the brand beyond its core collectibles busi-ness with the aim of creating a global

Postal Service and eBay have teamed up to make it easier for eBay sellers to ship items by featuring postal products and services and by offering online access to useful shipping solutions. USPS and eBay are offering eBay sellers the ability to access existing postal solutions that will enable them to print shipping labels, pay postage and check the delivery status of their items - conveniently from eBay. Buyers will be able to calculate shipping costs online, and there will be no need for eBay buyers or sellers to conduct transactions at Post Offices. Early next year, the parties anticipate that these same features will be integrated and accessible from sellers' eBay accounts. "eBay sellers rely on the Postal Service to deliver their items sold online. Working with eBay, we have made it easier and more convenient for sellers to prepare and pay for their sold products without leaving their homes," said USPS Postmaster General and CEO John E. Potter.   At the same time, eBay was exploring new marketplace models to supplement its traditional auction model and found that its infrastructure was not flexible enough to support its new initiatives and its long-term strategy of becom-ing a marketplace that supported all models of commerce. The key would be to move from a monolithic application architecture to a services- and component-based architecture that would take eBay into the future. Schwab.) eBay then turned to Sun Services to help with its J2EE technology-based architecture design and implementation. And Phase Three-the long-term migration of virtually all eBay functionally to the new architecture-is scheduled for completion mid 2004. Most importantly, eBay is now on the road to a more viable, flexible, and scalable architecture upon which to build its future. On any given day, there are more than 12 million items listed on eBay across 18,000 categories for sale on eBay, with customized trade enabled for markets around

Jeff Jordan Statement Final

My name is Jeff Jordan, and I am Senior Vice President & General Manager of eBay Inc.'s U.S. Operations. Thank you for inviting eBay to participate in this workshop on the potential negative effects that state regulations can have on the Internet and e-commerce. eBay, e-Commerce and the State and Local Response eBay is the world's first and largest online trading community. Founded in September 1995 by Pierre Omidyar, eBay brings together people and companies from around the world in an online venue where they can buy and sell just about anything. Pierre's vision in creating eBay was to design the ultimate, efficient marketplace. Today, with over 50 million registered users worldwide and over 10 million items for sale daily, the eBay community is fulfilling that vision. Whether selling through a bidding process or fixed-price format, sellers on eBay must charge prices that are competitive not just with other eBay sellers, but also with offline and online retailers.   A lack of policy guidelines for appropriate protection of intellectual property, which can easily be accessed and rendered by implementation of agent-based technologies, is demonstrated by the recent case of eBay vs. Bidder's Edge. The Case of eBay vs. Bidder's Edge7 The algorithms underlying intelligent agents are relatively a contemporary technology (when put on a historical time scale or even placed along the rapid evolution of com-puter science) and their technological potential has not fully been grasped. eBay is the largest provider of auction services via the Net. During the period of its operation, eBay's consumer base counts for seven million reg-istered users and over 400,000 items are added to its auctions every day (more than 3 million items are available for purchase at any given time). Bidder's Edge is a small provider of auctions online founded in 1997 and a one of eBay's minor rivals. The system sends software agents to search for similar records in other

The eBay service permits sellers to list items for sale, buyers to bid on items of interest and all eBay users to browse through listed items. Sellers are attracted to eBay as a result of the large number of potential buyers and buyers in turn are attracted to eBay by the broad selection of goods listed on eBay. The critical mass of items listed on eBay provides a mutual benefit for buyers and sellers to more effectively determine an appropriate price for an item. The Company believes that building greater awareness of the eBay brand within and beyond the eBay community is critical to expanding its user base and to maintaining the vitality of the eBay community. Typically, sellers have a credit card account on file with eBay and that account is charged shortly after the invoice is sent. As the eBay community grows and additional items are listed, the Company will continue to organize auctions under additional categories to respond to the needs of the eBay

LAW Recently there has been an increased level of illegal trafficking in county records on Ebay. We urge you to set up an account on Ebay so that you can regularly monitor the items for sale. As you gain familiarity with Ebay, you will be able to find targeted items more effectively and efficiently. If you discover that your county's records are being bought and sold on Ebay, we recommend the following steps: It is difficult to contact Ebay directly, but they will respond to law enforcement inquiries. The published fax number to reach them is 408-967-9915 and the published email is stopfraud@ebay.com. Ebay does not have a published phone number. Only law enforcement can find out the true identify of the seller, although it is possible for any Ebay subscriber to contact Ebay sellers through email. Enclosed you will find a brief article on the problem of stolen documents for sale on Ebay, as well as a copy of the Replevin law and a brief interpretation of it.

Executive Summary Market conditions continued to strengthen as evidenced by a decline in vacancy for the third consecutive quarter. Almost 400,000 square feet of vacant space was occupied by tenants this quarter, bringing the vacancy rate down to 13.7 percent from 14.4 percent. Vacancy in the market has declined 2.2 percentage points from its peak just three quarters ago. Sublease space also continues to diminish at what seems to be an accel-erated pace, shedding over 460,000 square feet this quarter and dropping the sublease rate 80 basis points to 3.0 percent. Sublease space in the East Bay market has now declined for six consecutive quarters and is almost 2 million square feet below its year-end 2002 peak. This positive momentum has kept overall rents in the market firm with some select submarkets experiencing moderate increases this quarter. Class A rents in the Oakland CBD, Contra Costa Centre, Pleasanton and Downtown Walnut Creek submarkets have all edged upward. These
