This had recommended fundamental changes to the structure of the management of the Criminal Justice System (CJS) and proposed that, at the national level, a National Criminal Justice Board and a Criminal Justice Council (replacing the Criminal Justice Consultative Council) should be established.
A National Criminal Justice Board (NCJB) to oversee the local boards and to manage the CJS at a national level had been established.

The Crime and Disorder Act 1998 requires that each local authority should be set up a Youth Offending Service (YOS), the principal aim being to prevent offending by children and young people.
They will focus on tackling offending behaviour and the risk factors associated with it and co-ordinating the provision of Youth Justice Services following the directions of National Standards.

Although Security Council Resolution 1483 adopted on May 22, 2003, makes reference to transitional justice in its preamble,2 it provides no guidance on how to deal with past crimes in Iraq or who should bear responsibility for formulating transitional justice policy.
Iraqis should ultimately determine this policy, but the establishment of a genuinely representative Iraqi government is unlikely in the short term.
In order to avoid conflict over witnesses and evidence, a liaison mechanism could be established between the special tribunal and domestic prosecutors (roughly analogous to that established between the Truth Commission and the Serious Crimes Panels in East Timor), whereby domestic prosecutors seek clearance prior to embarking on the investigation and prosecution of specific targets or categories of people.
